Terms of Service

These Terms of Service (the “Terms”) govern access to and use of the MCX Commissioning Platform — the website at mccommissioning.com and the application at app.mccommissioning.com (together, the “Service”) — operated by Mission Critical Engineers (“MCE”, “we”, “us”). By creating an account or using the Service you agree to these Terms.

1. The Service

MCX is a software platform for managing commissioning of data centers and other critical facilities: test programs, checklists, execution records, deficiencies, schedules, documents, and related project information. The Service is provided to invited organizations and their project teams.

You own your project data. Content that you or your organization enter into the Service — project records, test results, documents, signatures, and similar material (“Customer Data”) — remains the property of you or your organization. You grant us the limited rights needed to host, process, display, back up, and transmit Customer Data solely to operate and support the Service.

You are responsible for having the necessary rights to the Customer Data you upload, and for its accuracy. Commissioning records generated in the Service support, but do not replace, your own professional judgment and contractual obligations.

We work to keep the Service available and your data safe, but the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We may modify features of the Service as it evolves.

6. Limitation of Liability

To the maximum extent permitted by law, MCE will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business opportunity, arising out of or related to the Service. To the maximum extent permitted by law, MCE’s aggregate liability arising out of or relating to the Service will not exceed the amounts paid by your organization for the Service in the twelve months preceding the claim, or one hundred U.S. dollars if no such amounts were paid.

7. Intellectual Property

The Service, including its software, design, and branding, is the property of MCE and its licensors and is protected by intellectual-property law. These Terms grant no rights to the Service other than the limited right to use it as intended.

8. Termination

You may stop using the Service at any time and may request deletion of your account. We may suspend or terminate access for material breach of these Terms. Upon termination of an organization’s use of the Service, we will, on request within a reasonable period, provide an export of that organization’s Customer Data in a common format before deletion.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be indicated by updating the date above, and where practical by additional notice in the Service. Continued use after changes take effect constitutes acceptance.
